Thank you for accessing/shopping at cocopeach.co. This site is owned by Knitcraft Actilife (hereinafter referred to as cocopeach.co). By accessing, shopping on this site, you indicate your unconditional acceptance of these terms & conditions. We reserve this right, in our sole discretion, to update or revise these terms & conditions. Continued use of the site following the posting of any changes to the ‘terms & conditions’, constitutes your acceptance of those changes. At cocopeach.co, we try our best to create a space where you can explore and shop for all your favorite things in a safe and secure environment. All products and information displayed on http://cocopeach.co constitute an "invitation to offer". http://cocopeach.co reserves the right to accept or reject your offer. Your order for purchase, constitutes your "offer" which shall be subject to the terms and conditions as listed below.

In this contract 'We', 'us' or 'our' means COCOPEACH, accessible from http://cocopeach.co

Eligibility to use our site

Use of the Site is available only to persons who can legally enter into contracts under applicable laws. Persons who are "incompetent to contract", within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. cocopeach.co reserves the right to terminate your access to the Site if it discovers that you are under the age of 18 years or suffers from any other disability, as recognized under Indian Contract Act, 1872.

You may only buy goods from our site for non-business reasons.

Ordering goods from us

Although it's not essential to have an account to shop with http://cocopeach.co, you can shop as a guest. As a member, you agree to provide true, accurate, current, and complete information about yourself as prompted by the site's registration form. Registration where prohibited under any law shall be void. http://cocopeach.co reserves the right to revoke or terminate your registration for any reason at any time, without notice.

You place an order on the site by adding your selected item(s) to the shopping bag and proceeding to checkout. Items in your shopping bag are not reserved and may be purchased by another customer. Please read and check your order carefully before submitting it.

When you place your order at the end of the online checkout process (i.e. when you click on "Pay"), we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted.

We may contact you to say that we do not accept your order. This is typically for the following reasons:(a) the goods are unavailable;(b) we cannot authorize your payment;(c) you are not allowed to buy the goods from us;(d) we are not allowed to sell the goods to you;(e) you have ordered too many goods; or(f) there has been a mistake on the pricing or description of the goods.

We will only accept your order when we email you to confirm this (Confirmation Email). At this point:(a) a legally binding contract will be in place between you and us; and(b) we will dispatch the goods to you or inform you of the estimated dispatch date.

When you use the site or send emails or other data, information or communicate to us, you agree and understand that you are communicating with us electronically and give your consent to receive communications electronically from us periodically, when required.

Delivery

Once you have placed an order, this cannot be cancelled at any stage. The contract is completed on receipt of the order.

We will deliver your purchases using the delivery method that you select during the checkout process.

The estimated date for delivery of the goods is set out in the Confirmation Email (Usually between 7-14 working days). This date is an estimate only and we do not guarantee to deliver the goods on that date.

We require that all deliveries are accepted by a person at the delivery address. You agree that delivery takes place when the goods are signed for at the delivery address and the signature of the person at the delivery address is conclusive evidence that the signed-for goods have been delivered to you at that address. 

If nobody is available to take delivery, please contact us using the contact details at the top of this page to arrange an alternative delivery.

You are responsible for the goods when delivery has taken place. In other words, the risk in the goods passes to you upon delivery.

We may deliver your goods in installments.

Payment

We accept the following payment methods: Visa, MasterCard, American Express, Visa Debit, and UPI. We do not accept any other method of payment.

We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorized access to any information that you give us.

Your credit card or debit card will only be charged the order is placed.

The price of the goods is in the currency shown at the checkout. You are responsible for any charges that your payment card provider may apply for making payment in that currency.

The price of the goods does not include the price of delivery, which will be shown separately at the checkout and on the Confirmation Email.

If the shipping address of your goods is in India the price of the goods includes sales tax and duties.

If the shipping address of your goods is outside India the price of the goods does not include sales taxes, import duties or other levies, and you will be responsible for paying those. In some cases, payment of those charges may be necessary in order to release your goods from customs.

Nature of the goods

While we try to make sure that all weights, sizes and measurements set out on the site are accurate, there may be small differences between the weights, sizes and measurements of goods shown on the website and the actual goods we supply.

While we try to make sure that the colors of our goods are displayed accurately on the site, the actual colors that you see on your computer may vary depending on the monitor that you use.

Many of our garments are hand finished or hand embroidered. By their nature these garments may exhibit small irregularities and may vary from examples shown on the website; this is not a manufacturing fault. Garments featuring hand embroidery or hand finishing or incorporating fabrics such as chiffon and georgette are by their nature susceptible to pulls and rips and are not designed for hard wearing.

The packaging of the goods may be different from that shown on the site.

Returns or Exchanges

This clause sets out the only circumstances in which we will accept returns or offer refunds for goods. We will not accept returns or offer refunds for goods unless they are faulty. For this purpose, the customer needs to notify us within 7 days from the date of delivery.

If your goods are faulty when they are delivered you may return the faulty goods to us. If you return the goods to us, we will (at our option) repair or replace the goods or provide you with a refund of the purchase price and the price of delivery.

In order to return faulty goods you must contact us at marketing.cocopeach@gmail.com  to inform us that you wish to return the goods. We will then provide you with details of where to return the goods and how to complete the returns process. You will be responsible for the costs of delivering the goods back to us.

If we repair or replace the goods, we will deliver the repaired or replaced goods to you at no additional cost to the delivery address you specified when you purchased the goods.

If we provide a refund(under a special circumstance), we will pay it to the account you used to purchase the goods.

Order Cancellation

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

  • Goods availability
  • Errors in the description or prices for Goods
  • Errors in Your Order

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

Your Order Cancellation Rights

Any Goods you purchase can only be returned in accordance with these Terms and Conditions and Our Returns Policy.

Our Returns Policy forms a part of these Terms and Conditions. Please read our Returns Policy to learn more about your right to cancel Your Order.

Your right to cancel an Order only applies to Goods that are returned in the same condition as You received them. You should also include all of the products instructions, documents and wrappings. Goods that are damaged or not in the same condition as You received them or which are worn simply beyond opening the original packaging will not be refunded. You should therefore take reasonable care of the purchased Goods while they are in Your possession.

We will reimburse You no later than 14 days from the day on which We receive the returned Goods. We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement.

You will not have any right to cancel an Order for the supply of any of the following Goods:

  • The supply of Goods made to Your specifications or clearly personalized.
  • The supply of Goods which according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is over.
  • The supply of Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  • The supply of Goods which are, after delivery, according to their nature, inseparably mixed with other items.
  • The supply of digital content which is not supplied on a tangible medium if the performance has begun with Your prior express consent and You have acknowledged Your loss of cancellation right.

Reviews, Feedback, Submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to http://cocopeach.co directly or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively referred to "Comments") will remain http://cocopeach.co property. Such disclosure, submission or offer of any comments shall constitute an assignment to http://cocopeach.co of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the comments,thus, it exclusively owns all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise. http://cocopeach.co will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. http://cocopeach.co is and shall be under no obligation (1) to maintain any Comments in confidence; or (2) to pay you any compensation for any Comments; or (3) to respond to any Comments. Accuracy of Content/ Information of Products on the Web Site

While http://cocopeach.co strives to provide accurate product and pricing information, typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, http://cocopeach.co shall have the right, on our sole discretion, to modify the price of the products, or information of the products or to refuse or cancel any orders placed for that product, unless the product has already been dispatched. End of the contract 

If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

Limit on our responsibility to you

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for:

losses that:

(a) were not foreseeable to us when the contract was formed; or

(b) that were not caused by any breach on our part.

PAYMENTS

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express cards or online payment methods (PayPal, for example).

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

Business Losses.

Except for any legal responsibility that we cannot limit in law (such as for death or personal injury), our whole liability to you in connection with your purchase will be limited to the amount that you paid us for the goods and delivery.

Disputes

We will try to resolve any disputes with you quickly and efficiently.

If you are unhappy with the goods, our service to you, or any other matter, please contact us as soon as possible.

If you want to take court proceedings, the courts of India will have exclusive jurisdiction in relation to this contract.

Indian law will govern this contract and any claims or disputes arising out of or in connection with it (including non-contractual claims and disputes).
